A. TERMS OF USE Introduction

  1. These Terms set out the legally binding terms which apply to everyone who accesses or uses the website at www.odeon.co.uk ("Website"). Please read the Terms carefully before using this Website. By accessing or using this Website, you agree to be bound by these Terms. If you do not wish to be bound by these Terms, you must leave this Website immediately.
  2. This Website is owned and operated by ODEON Cinemas Limited (a company registered in England, whose registered office is at 54 Whitcomb Street, London, WC2H 7DN, company number 01854132) ("ODEON", "we", "us", "our"), for and on behalf of itself and the members of the International ODEON / UCI Group of Companies ("ODEON Group"). A list of such companies from time to time can be found linked to our Privacy and Cookie Policy. You agree that companies which are members of the ODEON Group shall be entitled to benefit from the terms within these Terms which are intended to benefit ODEON Cinemas Limited.

Your statutory rights

  1. Nothing in these Terms affects your statutory rights as a consumer, or excludes or limits our liability for fraud, or for death or personal injury resulting from our negligence, or for any other liability which we cannot exclude or limit under law.

You are permitted to display the materials on this Website on a computer screen and to download and print a hard copy of such materials strictly for your own personal use and provided you do not alter or remove any copyright, trade mark or other proprietary notices. You undertake not to:
    1. Commercially exploit any materials on this Website without our express prior written consent;
    2. Establish a link to this Website from any other website, intranet or extranet site, without our express prior written consent;
    3. Use this Website to upload or distribute any material that contains viruses or anything similar;
    4. Infringe the rights of any other person;
    5. Do anything that will or may interfere with, disrupt, damage or impair this Website or our provision of services; and/or
    6. Submit any information to this Website which is defamatory, obscene, offensive, liable to cause harassment or distress and/or which does not comply with any law.
  2. You may not frame or use framing techniques to enclose any material on this Website or any part of it without our express prior written approval. User names and passwords

Availability of this Website

  1. This Website is provided free of charge and we make no guarantee that it will be uninterrupted or error free. In addition, we reserve the right to modify or discontinue, temporarily or permanently, all or any part of this Website without notice and without liability.

Links from this Website to third party websites

  1. This Website contains links to other websites which are not controlled by us. For example, if you click on a banner advertisement, the click may take you off this Website. The fact that we may provide a link to any such website does not mean that we endorse that website. Such links are provided only for your convenience and we have no control over such websites. Subject to paragraph 3 ("Your statutory rights"), your access to and use of such websites is at your own risk and we shall have no liability in respect of those websites.

B. Ticket Purchase Terms Online ticket purchases

  1. Except in accordance with paragraph 30 there are no rights of refund or exchange and you acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer.
  2. The FAQs contain details of how to place your order for a cinema ticket, including how to correct input errors during the ordering process. We advise you to read these FAQs before you proceed to place an order for a cinema ticket. English is the only language offered for the conclusion of the contract for the purchase of cinema tickets.
  3. When you purchase a ticket to see a film via the ordering process set out on this Website and in accordance with the information set out in the FAQs and these Terms, the identity of the company within the ODEON Group from whom you purchase the ticket will depend on the cinema you have selected. This company will be one of the following (and the precise company can be identified by clicking on this link):
    1. ODEON Cinemas Limited (registered office at 54 Whitcomb Street, London WC2H 7DN; company number 01854132);
    2. United Cinemas International (UK) Limited (registered office at Lee House, 90 Great Bridgewater Street, Manchester, M1 5JW; company number 01732125);
    3. ABC Cinemas Limited (registered office at 54 Whitcomb Street, London WC2H 7DN; company number 03167622);
    4. All UCI or Thefilmworks Cinemas in Republic of Ireland: United Cinemas International (Ireland) Limited (registered office at Lee House, 90 Great Bridgewater Street, Manchester, M1 5JW; company number 136701).
  4. The Prices of the tickets are those displayed on the Website from time to time, during the ordering process, except in cases of obvious error. In addition to the ticket price a Card Handling Fee (levied by Bookit Ltd (a member of the ODEON Group which acts as an agent of the relevant company in paragraph 14 above) in consideration for processing your credit/debit card transaction with its bankers), is payable on online and telephone transactions, and this will be notified to you during the ordering process. All prices and fees include any applicable Value Added Tax. For users in the United Kingdom all prices are in pounds sterling, and for users in the Republic of Ireland, all prices are in Euros.
  5. Remote payment can be made by any method specified in the FAQs. Bookit Ltd will deduct your payment from your card at the time it processes your credit/debit card transaction. You cannot use any promotional vouchers or discount cards in conjunction with a ticket purchase via this Website (if you wish to do this, you will need to visit a cinema in person). You cannot use guest passes to pay for a ticket purchase via this Website (if you wish to do this, you will need to visit a cinema in person or phone the booking number on the back of the guest pass). If you are a student, you can still benefit from the student price, but you must bring your proof of student identity to the cinema when you collect your tickets (see the FAQs for details of the type of proof we accept).
  6. When you purchase a ticket via this Website, all transaction details that you provide to Bookit Ltd (including your name and credit card details) will be held and used in accordance with our Privacy and Cookie Policy and will be encrypted using SSL (secure sockets layer) technology. Bookit Ltd will take reasonable steps to safeguard transaction details, but you acknowledge and agree that the use of Internet booking can never be completely secure. Subject to paragraph 3 ("Your statutory rights"), unless either Bookit Ltd or ODEON has been negligent, Bookit Ltd and ODEON shall not be liable for any loss or damage you may suffer as a result of the loss of confidential or personal information provided to Bookit Ltd via this Website.
  7. For the avoidance of any doubt, where a transaction is not completed for whatever reason, Bookit Ltd will not have levied its Card Handling Fee, as your credit/debit card transaction will not have been completed.
  8. The sale of cinema tickets is subject to availability. Your order for a cinema ticket is an offer to purchase a ticket from the relevant company specified in paragraph 14, and ODEON retains the discretion to refuse your order on behalf of the relevant company specified in paragraph 14. If ODEON accepts your order, which it may do on behalf of the relevant company specified in paragraph 14, we will display a confirmation page on your screen at the end of the ordering process, and at this point there will be a contract between you and the relevant company specified in paragraph 14. Such a contract will be governed by English Law and will be subject to the non-exclusive jurisdiction of the English Courts. We will also send to you a secondary e-mail confirmation of your completed order, for your information. We do not file details of your order for you to access on this Website, so we recommend that you print out a copy of the confirmation page and/or confirmation e-mail for your records.
  9. Tickets can be collected from the box office in your chosen cinema when your credit/debit card transaction and the entire ordering process has been completed. Some cinemas also have automatic ticket machines ("ATMs") from which you can collect your tickets. If you have purchased a student ticket, you may not be able to use the ATMs because our staff may want to check your proof of student identity before you are admitted. For security reasons, the cardholder must be present to collect the tickets, and you will need to take the same card as you have used to make your booking.
  10. You represent and warrant that any tickets you purchase are for personal use only, and that they are not purchased as part of any form of for profit business or commercial activity, unless we have expressly authorised otherwise in writing.
  11. You undertake that you will not resell or offer for resale any tickets (whether at a premium or otherwise) or use tickets for advertising or promotions (including prize draws, competitions, contests and/or sweepstakes) or for any other trade purposes. If you resell or offer for resale any tickets, then they will be invalid.
  12. It is your responsibility to check your tickets as we are under no obligation to rectify mistakes after a contract has been formed. Please also note that we are not under an obligation to provide the ticket(s) to you at the incorrect (lower) price, even after the confirmation page has been displayed and the confirmation email has been sent to you, if such a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mis-pricing.
  13. Seating will be unreserved unless otherwise specified expressly during the ordering process.
  14. It is your responsibility to ascertain whether a screening has been cancelled or rescheduled. If a screening is cancelled or rescheduled (for whatever reason), we will use reasonable endeavours to notify you of the cancellation or rescheduling but we do not guarantee that you will be informed of such cancellation or rescheduling before the date of the screening.
  15. We will not be responsible for any tickets that are lost or stolen.
  16. The unauthorised use of photographic and recording equipment in our cinemas is prohibited.
  17. We accept no responsibility for any personal property that is brought to a cinema.
  18. Price and availability information is subject to change without notice.
  19. Unless otherwise expressly stated on this Website, tickets cannot be exchanged or refunded.
  20. All purchases of tickets are also subject to ODEON's "General Admission Terms" (copies of which are displayed in our cinemas and which are available upon written request made to our Guest Services department, whose contact details can be found via the Contact us link). The "General Admission Terms" are deemed to form part of these Terms and are hereby incorporated into these Terms by reference.
  21. In the event of a conflict or inconsistency between ODEON's "General Admission Terms" and these Terms, these Terms shall prevail to the extent of such conflict or inconsistency.
  22. We reserve the right to refuse admission should you breach any of ODEON's "General Admission Terms" or these Terms and we may on occasions have to conduct security searches to ensure your safety.

C. Other Terms Non-compliance with these Terms:

  1. We reserve the right to investigate any suspected non-compliance with these Terms. If we believe that a violation of these Terms (or any of the rights identified in these Terms) has occurred, we may suspend or bar your access to this Website or take such other corrective action as we deem appropriate.

Limitations on ODEON's liability to you

  1. We will use reasonable endeavours to ensure the accuracy of any information on this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be accurate, current, complete, or error-free. Unless we have been negligent, we accept no liability of any kind for any loss or damage arising from action taken in reliance on information on this Website.
  2. We will use reasonable endeavours to exclude computer viruses from this Website, but we make no representation or warranty of any kind that this Website or any of its contents will be free from computer viruses introduced by third parties. Unless we have been negligent, we accept no liability of any kind for any loss or damage caused by computer viruses.
  3. Subject to paragraphs 3 ("Your statutory rights") and 38, in the event that you purchase cinema tickets online via this Website, our liability (whether in contract, tort (including negligence), statute or otherwise) arising out of or in connection with the purchase of those tickets shall be limited to the price paid by you for those tickets.
  4. Subject to paragraph 3 ("Your statutory rights"), we will not be liable to you for any:
    1. Loss of profits;
    2. Loss of revenue;
    3. Loss of anticipated savings;
    4. Loss of business;
    5. Loss of opportunity;
    6. Loss of data;
    7. Loss of or damage to goodwill or reputation; or
    8. Any indirect or consequential loss or damage,
      whether arising under contract, tort (including negligence), statute or otherwise.
  5. To the fullest extent permitted by law, all implied terms, whether by statute or otherwise are excluded

Events outside our control

  1. We will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations that are caused by events outside our reasonable control.

Jurisdictional issues

  1. This Website is directed only at users in the United Kingdom and the Republic of Ireland and you may only use this Website to purchase tickets if you are domiciled in the United Kingdom or Republic of Ireland. If you access this Website from outside the United Kingdom and Republic of Ireland, you do so at your own initiative and risk, and you are responsible for compliance with any applicable local laws.
  2. These Terms and your access to or use of this Website are governed by the relevant law listed below, and any dispute arising in connection with this Website shall be subject to the non-exclusive jurisdiction of the relevant court listed below:
    1. For users in the United Kingdom, the law and courts of the relevant part of the United Kingdom;
    2. For users in the Republic of Ireland, the law and courts of the Republic of Ireland; and
    3. For users in any other jurisdiction, the law and courts of England

Changes to the Terms

  1. Not withstanding anything to the contrary, we reserve the right to amend these Terms (including our "General Admission Terms") from time to time without notice. Amendments will take effect when posted on this Website, or in the case of the "General Admission Terms", when made by us. Please check this Website and (in particular), this page regularly for changes or information about changes. If you access or use this Website after any amendment to these Terms has taken effect, you hereby agree to be bound by the updated version of these Terms.

Prize draws and competitions

  1. By entering an ODEON prize draw or competition, unless specific prize draw or competition terms are set out in conjunction with the details of that prize draw or competition (in which case the prize draw or competition will be governed by such terms), you agree to be bound by the terms and conditions set out below:
    1. To enter an ODEON prize draw or competition, without purchasing a cinema ticket, please send your entry along with a SAE to the ODEON Marketing Department at 54 Whitcomb Street, London, WC2H 7DN. We will then place your entry into the draw;
    2. Winners will be contacted by an appropriate method within 28 days of the notified closing date;
    3. All prizes are non-transferable;
    4. Judge's decision is final. No correspondence will be entered into;
    5. No cash alternative. The promoter reserves the right to substitute prizes with goods of an equal or greater value in the unlikely event that these exact prizes become unavailable;
    6. No trade, consumer groups or 3rd party applications acceptable;
    7. The promoter reserves the right to disqualify incomplete, altered or illegible entries;
    8. The promoter is ODEON Cinemas Limited, 54 Whitcomb Street, London WC2H 7DN;
    9. The competition/prize draw is governed by the law of England and Wales.
